Terms and Conditions

 

1. General

These Terms and Conditions govern the sale of MACx GPU hardware products and related services provided by Toraks d.o.o. to business customers (B2B only).

By placing an order, the customer agrees to these Terms and Conditions.

 

2. Orders

All orders are subject to written confirmation by Toraks d.o.o.

Toraks d.o.o. reserves the right to refuse or cancel any order prior to shipment.

 

3. Pricing and Payment

All prices are quoted in EUR and exclude VAT unless stated otherwise.

Payment terms are defined in the official offer or contract.

Toraks d.o.o. reserves the right to charge statutory interest on late payments.

 

4. Delivery

Delivery times are estimates and are not legally binding unless agreed in writing.

Risk transfers to the customer upon shipment from the Toraks warehouse or agreed delivery location.

 

5. Warranty

Toraks d.o.o. provides a 24-month limited warranty from the date of delivery.

The warranty covers manufacturing defects under normal operating conditions.

The warranty does not cover damage resulting from:

• improper installation

• misuse or modification

• external factors beyond reasonable control

Warranty claims must be submitted in writing.

 

6. Limitation of Liability

Toraks d.o.o. shall not be liable for indirect or consequential damages, including but not limited to loss of profits, business interruption, or data loss.

Total liability shall not exceed the purchase price of the product.

 

7. Technical Information

All technical specifications and performance data are provided for informational purposes only. Actual performance may vary depending on system configuration and workload.

 

8. Governing Law

These Terms and Conditions are governed by the laws of the Republic of Slovenia.

Any disputes shall be resolved by the competent court in Slovenia.

 

9. Changes

Toraks d.o.o. reserves the right to update these Terms and Conditions at any time.
